CONSTITUTION OF THE NORTHERN’S CRICKET UNION’S COACHING ASSOCIATION
1 NAME
1.1 The Association shall be known as the NORTHERNS CRICKET UNION COACHING ASSOCIATION (hereafter referred to as the NCUCA)
2 HEADQUARTERS
2.1 The headquarters of the NCUCA will be at SuperSport Park
3 OBJECTIVES
3.1 To provide a forum for the enhancement of cricket coaching
3.2 To create opportunities for players to enhance their techniques and performances
3.3 To promote cricket coaching in all communities
3.4 To enlighten coaches in all aspects of the game
3.5 To create opportunities for the advancement of coaches
3.6 To foster good relationships fellowship and common purpose amongst its members, members of other similar associations as well as members of the cricket fraternity at large
3.7 To raise funds in support of its aims
3.8 To participate in other projects that will enhance its aims
3.9 To recommend coaching standards and governance to the Northerns Cricket Union (hereafter referred to as the NCU)
3.10 To entrench the Union’s principles of transformation in all its endeavours
4 AFFILIATION
4.1 The NCUCA shall be affiliated to the NCU and shall subject itself to the NCU’s requirements
4.2 The executive committee of the NCUCA (EXCO) will consider all requests of independent coaches and coaching forums to affiliate to the NCUCA
5 MEMBERSHIP
5.1 Membership is open to all coaches who, in the opinion of the NCUCA, will contribute to the objectives of the NCUCA
5.2 Members of the NCU Amateur Cricket Department and coaches employed by NCU or CPI, are automatically ordinary members of the NCUCA
5.3 Membership shall comprise Ordinary and Honorary Life members
5.3.1 Ordinary membership
5.3.1.1 Applications must be accompanied by the stipulated entrance fee and submitted to the EXCO for approval
5.3.1.2 The Secretary of the NCUCA will advise successful applicants within seven days after the EXCO has made its decision. A copy of the Constitution, bye-laws and other codes will simultaneously be made available
5.3.1.3 Notifications re unsuccessful applications, will be accompanied by a refund of the entrance fee
5.3.1.4 Termination of membership will follow either -
• a written notice by the member concerned;
• termination through the disciplinary procedures; or
• failure to renew membership fees by the stipulated cut-off date; or
• ceasing to be an employee of the Union’s amateur or professional departments (automatic ordinary membership)
5.3.1.5 Outstanding membership fees are recoverable from members whose memberships are terminated for whatever reasons and the EXCO may take any steps it may deem necessary to recover such outstanding monies
5.3.2 Honorary Life Members
5.3.2.1 It is the prerogative of the EXCO to nominate Honorary Life members from its membership who have made outstanding contributions to the NCUCA in terms of promoting the quality of cricket over a period of time. Such nominations will be ratified by the membership at the Annual General Meeting (AGM)
5.3.2.2 Honorary Life membership will only be awarded if the nominee receives at least 80% of the votes of the members present and voting
5.3.2.3 Although Honorary Life members may attend and participate in all meetings of the NCUCA, they may not vote or make nominations in respect of voting matters
5.3.2.4 Honorary Life members are not liable for subscriptions
5.3.2.5 The term of Honorary Life members shall expire upon death, or resignation by such member or should the EXCO unanimously resolve to terminate a Honorary Life member’s membership
6.0 ANNUAL GENERAL MEETINGS
6.1 The Annual General Meeting (AGM) of the NCUCA shall take place in September of each year
6.2 Written notice of the AGM must be sent to all members at least 14 days prior to the date of the AGM. A copy of the agenda, annual report, annual financial statements and minutes of the previous AGM, shall accompany the notice
6.3 A quorum shall consist of 50% of the members that are entitled to vote. Only members who have paid the subscription/membership fees and who are otherwise in good standing with the NCUCA, will be entitled to vote
6.4 In the event of a quorum not being present, the meeting shall stand adjourned for a period not exceeding seven days, whereupon the members present shall constitute a quorum
6.5 The AGM shall be chaired by the Chairman, or in his absence, the Vice- Chairman. If none of them are available, the remainder of the EXCO will appoint a chairperson, failing which the floor will make an appointment
6.6 The business of the AGM shall be to-
6.6.1 confirm and accept the minutes of the previous AGM
6.6.2 present and accept the Annual Report of the EXCO
6.6.3 present and accept the Annual Financial statements
6.6.4 elect the EXCO members in terms of paragraph 8 of this Constitution
6.6.5 consider and vote on nominations for Honorary Life members
6.6.6 appoint an Auditor who shall not be a member of EXCO
6.6.7 conduct any special business as called for by the AGM
6.6.8 consider and vote on any proposed amendments to the Constitution
7.0 Special General Meetings
7.1 Special General meetings may be called for-
7.1.1 the EXCO when it deems it necessary to do so
7.1.2 by a written request of at least 70% of the membership entitled to vote at an AGM to discuss a specific topic. The EXCO will have to give at least 30 days notice of such a meeting. Only the specific topic raised will be discussed at such meeting
7.1.3 The same application of quorums, adjournments and chairmanship as applicable to an AGM, will apply at a Special General meeting
8.0 Executive Committee
8.1 The authority to manage the affairs of the NCUCA will be vested in the Executive Committee (EXCO)
8.2 The EXCO shall consist of seven members (in good standing), duly elected at an AGM for a period of two years, who shall all enjoy full voting rights
8.3 Nominations for election to the EXCO must be made by members in good standing and must reach the office of the Manager, Amateur Cricket at least 21 days before the AGM. Nominations must be seconded by another member (in good standing) and accepted in writing by the candidate. The list of nominations will be distributed to the members at least one week prior to the AGM
8.4 If insufficient nominations are received, the members nominated will be elected automatically and the remainder of the positions will be filled through nominations from the floor at the AGM. The conditions of paragraph 8.5 will, however, be maintained
8.5 At least three of the seven members must be Black of which at least one must be African
8.6 The EXCO will elect a Chairman, Vice Chairman and Treasurer from within
its ranks
8.7 The chairman may not be available for re-election in that capacity after
serving as chairman for four consecutive years
9.0 Role and powers of the Executive Committee
9.1 The EXCO will manage the affairs/goals/objectives of the NCUCA on behalf of its members
9.2 The EXCO may co-opt members to perform certain tasks (start and end dates).
Such members may participate at EXCO meetings but will not enjoy voting
rights at EXCO meetings
9.3 The EXCO shall have the power to expel, suspend or otherwise deal with
members who breach the Code of Conduct or other rules of the NCUCA
9.4 The EXCO shall compile and maintain a register of all its members and make
such list available as and when requested by its membership
9.5 The EXCO will have no less than five meetings per annum
9.6 The EXCO must approach its membership to fill any vacancies that may occur
within its ranks
9.7 The EXCO may set examinations, conduct assessments or grade members as it
may decide. It may award appropriate certificates to members who have
satisfied laid down criteria. The EXCO may accept the value of a certificate issued by another cricket authority as being acceptable
9.8 The EXCO will be responsible to have a Code of Conduct drawn up
9.9 The EXCO will appoint someone from within its ranks to handle all
disciplinary matters
9.10 The EXCO will determine the entrance and annual subscription fees
9.11 The Treasurer will be responsible for the handling of all the NCUCA’s
financial matters and policies and as such will keep and provide proper records of all transactions for general meetings and the AGM
10.0 Voting
10.1 All members in good standing will be eligible to attend and vote at any meeting of the NCUCA
10.2 Voting shall be done by secret ballot and counted by independent scrutinizers
10.3 A simple majority shall prevail in all voting
10.4 The chairman at a meeting shall have a casting as well as a deliberate vote
10.5 The voting record shall be made available to any member in good standing upon written request, but such request shall only be entertained for a period of seven days after conclusion of the AGM
11.0 Amendments to the Constitution
11.1 Motivations for the amendment to the Constitution must reach the Chairman at least 30 days prior to the AGM or as per the requirements of a Special General meeting
11.2 At least 70% of the members present and entitled to vote, shall be required to
vote in favour of the amendments to ensure that it is passed
12.0 Dissolvement
12.1 If 70% of the members present and entitled to vote at a Special General
meeting, vote in favour of dissolving the NCUCA, the assets or liabilities shall become the responsibility of the NCU, which shall deal with it as it seems fit
This Constitution has been accepted at a Special General Meeting of the Northerns Cricket Union Coaches Association on this the day of 2003
